Terms of Service

1. Acceptance

By creating an account or using the KuberNodes API, dashboard, or any KuberNodes product (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

3. Account registration

You are responsible for maintaining the confidentiality of your API keys and credentials. You must notify us immediately at security@kubernodes.com if you believe your account has been compromised. KuberNodes is not liable for losses resulting from unauthorised use of your account.

4. Permitted use

You may use the Service to access blockchain node infrastructure for legitimate purposes. You must not:

• Use the Service for any illegal purpose or in violation of applicable laws
• Sublet, resell, or offer the Service as a competing product without a written reseller agreement
• Attempt to circumvent rate limits, quotas, or any access control mechanism
• Use automated tools to scrape, harvest, or exfiltrate data beyond normal API usage
• Transmit malicious code or perform denial-of-service attacks against the Service or downstream networks

5. Quotas, rate limits, and fair use

Your plan defines the request rate limits and monthly quotas applicable to your account. KuberNodes reserves the right to throttle or suspend accounts that materially exceed their plan limits or that negatively impact other users.

6. Service availability

KuberNodes targets the uptime level specified in your plan. Paid plans include an SLA with compensation credits for breaches. The free tier carries no uptime guarantee. We will make reasonable efforts to provide advance notice of planned maintenance.

7. Fees and billing

Fees are as published on the pricing page at the time of purchase or as agreed in a custom contract. Fees are non-refundable except where required by law or explicitly stated in our refund policy. We reserve the right to change pricing with 30 days’ notice.

8. Intellectual property

KuberNodes retains all rights to the Service, platform software, documentation, and branding. You may use our official SDKs and CLI under the terms of their open-source licenses. Nothing in these Terms grants you ownership of KuberNodes intellectual property.

9. Data

Our data practices are governed by the Privacy Policy. You retain ownership of any data you submit to the Service. You grant KuberNodes a limited licence to process that data solely to provide the Service.

10. Termination

You may terminate your account at any time in the dashboard. KuberNodes may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. On termination, your data is retained for 90 days and then deleted.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS”. TO THE FULLEST EXTENT PERMITTED BY LAW, KUBERNODES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KUBERNODES’ TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. KUBERNODES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Governing law

These Terms are governed by the laws of England and Wales. Disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

14. Changes

We may update these Terms. We will give 14 days’ notice of material changes by email. Continued use after the effective date constitutes acceptance.
